Terms of Service

Last updated: September 5, 2026

These Terms of Service ("Terms") govern access to and use of DataEgress (the "Service"). DataEgress is operated by FENGAMO CAPITAL SL ("DataEgress," "we," "us," or "our"). By creating an account or otherwise using the Service, you ("Customer," "you") agree to be bound by these Terms.

Service

DataEgress is scheduled data export and delivery infrastructure for B2B SaaS companies. You expose a fetchPage HTTP endpoint — using the DataEgress SDK or built directly against our API — that returns the rows you choose to include in a given export. On a schedule you define, or on demand, DataEgress calls that endpoint, assembles the returned rows into a CSV or Parquet file, and delivers the result to a destination you configure: a signed download URL we generate, or a storage bucket (for example, Amazon S3 or a compatible provider such as Cloudflare R2) that you or your own end customer controls.

The Service does not connect to your database, does not perform change-data-capture or replication, and does not decide what data leaves your systems — your fetchPage implementation does.

Accounts

You're responsible for keeping your account credentials, session, and API keys confidential, and for all activity that occurs under your account. Use a strong, unique password, and tell us right away if you believe your account or an API key has been compromised. You must provide accurate information when creating an account and keep it reasonably up to date.

Customer responsibilities

Because DataEgress only ever calls the endpoint you build and control, responsibility for what happens on your side of that boundary is yours. Specifically, you're responsible for:

  • Having the lawful right to process and export the data your fetchPage implementation returns, including any consents, contracts, or regulatory obligations that apply to it.
  • The correctness of that implementation — which rows it returns, how it enforces tenant isolation, and how it handles pagination and cursors.
  • The accuracy and ongoing validity of any destination credentials you provide, and the security of the destination infrastructure itself, which remains yours or your end customer's at all times, not ours.
  • Complying with any contractual or regulatory obligations you owe your own customers or users in connection with the data you export through the Service.
  • Not using the Service for any prohibited or abusive purpose (see Restrictions, below).

Data processing

DataEgress processes the data returned by your fetchPage endpoint solely on your instructions, to generate and deliver the exports you configure. We claim no ownership interest in that data, and we don't use it for any purpose other than providing the Service to you.

It's worth separating two categories of information:

  • Your data — the row-level content your fetchPage endpoint returns. This passes through the Service transiently, as described in our Privacy Policy, and is not retained in our application database.
  • Service data — information the Service itself generates or requires to operate: your account and organization details, dataset and destination configuration, schedules, API keys, and run metadata (status, row counts, checksums, timestamps). Service data is necessarily stored so the Service can function, and is covered in detail in our Privacy Policy.

Security

We maintain reasonable technical and organizational measures appropriate to an early-stage B2B service, including encryption of destination credentials at rest, hash-only storage of API keys, and organization-scoped access controls that keep one customer's configuration and run data separate from another's. Details, including what we do and don't currently claim, are on our Security page.

Availability

The Service is provided on an "as available" basis. We do not commit to a specific Service Level Agreement (SLA) or uptime percentage unless one has been separately negotiated and agreed to in writing. The reliability features built into the Service — retries, deterministic delivery keys, checksummed manifests — are product functionality intended to make individual exports trustworthy; they are not a substitute for, or equivalent to, a contractual uptime guarantee. The Service may be unavailable from time to time for maintenance, upgrades, or reasons outside our control.

Billing

Paid plans are billed through Stripe, our payment processor, according to the plan and billing interval you select at checkout, as described on our Pricing page or in a separate written agreement for custom arrangements. Fees are exclusive of taxes; where applicable, taxes are calculated and collected as part of checkout or invoicing. You can change or cancel your plan from the billing settings in your dashboard, and changes take effect as reflected there. We do not currently publish a refund policy beyond what our payment processor provides by default — if you have a specific billing question, contact us and we'll work through it directly.

Intellectual property

DataEgress and its underlying software, infrastructure, branding, and documentation are the property of FENGAMO CAPITAL SL. These Terms give you the right to use the Service as described here, and no broader license to our intellectual property. You retain all rights, title, and interest in your own data and content — nothing in these Terms transfers any of that to us.

Confidentiality

Each party may have access to the other's confidential information over the course of the relationship — for us, that includes your account configuration and destination credentials; for you, that may include non-public information about how the Service works. Each party agrees to protect the other's confidential information with at least the same degree of care it uses for its own confidential information of a similar nature, using it only as needed to provide or receive the Service, and not disclosing it to third parties except as required by law.

Restrictions

You agree not to, and not to permit anyone else to:

  • Use the Service to transmit unlawful, infringing, or malicious content.
  • Attempt to gain unauthorized access to the Service, to another customer's data, or to any system or network connected to the Service.
  • Attempt to bypass, disable, or interfere with any security, rate-limiting, or access-control mechanism of the Service.
  • Use the Service in a way that abuses shared infrastructure — for example, sustained excessive load intended to degrade the Service for other customers.
  • Reverse engineer the Service beyond what applicable law expressly permits.

Suspension and termination

You may stop using the Service and close your account at any time from your dashboard or by contacting us. We may suspend or terminate your access if we reasonably believe your use violates these Terms — including for security reasons, abuse of the Service, or non-payment — and where practical we'll make a reasonable effort to notify you first. We don't commit to a fixed notice period beyond what's practical in the circumstances. On termination, any outstanding fees remain due, and we'll make a reasonable effort to let you export your configuration before your data is deleted.

Liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by applicable law, DataEgress and FENGAMO CAPITAL SL will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service. This is proportionate, early-stage limitation language, not a claim to exclude liability that cannot lawfully be excluded — nothing here limits liability where applicable law does not allow it to be limited.

Changes

We may update these Terms and the Service itself as it evolves. When we make a material change to these Terms, we'll update the "Last updated" date above. Continuing to use the Service after a change takes effect means you accept the updated Terms.
